How to access development related documentation and information

Certain information may be available through the DA Tracker.

Development applications made after 1 July 2010

Development applications and any associated documents in relation to a proposed development, received after the the 1 July 2010, are classified as Open Access Information and includes the following:

  • Home warranty insurance documents
  • Construction certificates
  • Occupation certificates
  • Structural certification documents
  • Town planner reports
  • Submissions received on development applications
  • Heritage consultant reports
  • Tree inspection consultant reports
  • Acoustics consultant reports
  • Land contamination consultant reports

Note: This does not apply to so much of the information about development applications which consists of:

  • The plans and specifications for any residential parts of a proposed building, other than plans that merely show its height and external configuration in relation to the site on which it is proposed to be erected, or
  • Commercial information, if the information would be likely to prejudice the commercial position of the person who supplied it or to reveal a trade secret, or
  • Development applications made before 1 July 2010 and any associated documents received (whether before, on or after that date) in relation to the application.

Development applications made before 1 July 2010

Complete a Property Information Request form.                                                                                                                                                                                 

The following documents are available under the provisions of Clause 242 and 243 of the Environmental Planning and Assessment Regulation 2021;

  • Development Approvals
  • Construction Certificates
  • Subdivision Certificate, including endorsed plans
  • Occupation Certificates
  • Plans related to the issue of a Construction or Subdivision Works Certificate.

Viewing and Copies of Documents

Some open access documents require an appointment, in order to allow documents to be retrieved from hard copy files or transferred between offices. Appointments can be made to view documents at Council offices from 9am to 4.30pm, Monday to Friday (except public holidays). Open access information may be inspected free of charge. Copies can be supplied per council’s fees and charges, subject to copyright.

Copyright

Under the Copyright Act 1968 (Cth), Council can only provide copies of certain documents (such as plans and certain reports) where the copyright owner has consented or in other limited circumstances. Access to documents that are subject to copyright shall be granted by inspection only unless otherwise permitted by the Copyright Act 1968 (Cth).
